Effective Date: October 5, 2026
Welcome to Dr.Club ("we," "our," or "us"), a service provided by DrClub LLC, a Delaware Limited Liability Company (EIN: 41-5085318), with its registered office at 611 South DuPont Highway, Suite 102, Dover, DE 19901, United States, and its principal business address at 1604 Crittenden Street NW, Washington, DC 20011, United States. These Terms of Use ("Terms") govern your access to and use of www.drclub.com and our associated services, APIs, and AI-powered tools (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy (which details how we collect and use your data, including via analytics tools like Microsoft Clarity).
1. Description of Service
Dr.Club is a marketing and content creation automation platform designed for medical professionals. The Service utilizes artificial intelligence to generate social media strategies, draft content, and schedule posts across connected third-party platforms (e.g., Meta/Facebook, Instagram, LinkedIn, X/Twitter, Threads).
2. Eligibility
You must be at least 18 years of age to use the Service. By creating an account, you represent and warrant that you are at least 18 years old, that you have the legal capacity to enter into these Terms, and that all registration information you provide is truthful and accurate. Certain features of the Service are designed for licensed medical and healthcare professionals; by using such features, you represent that you hold the appropriate professional qualifications in your jurisdiction.
3. Strictly No Patient Health Information (Zero-PHI Policy)
Dr.Club is strictly a marketing tool, not a medical device, electronic health record (EHR) system, or telehealth platform.
- Absolute Prohibition: You are strictly prohibited from entering, uploading, or transmitting any Protected Health Information (PHI) as defined by the U.S. Health Insurance Portability and Accountability Act (HIPAA), or any Special Categories of Personal Data concerning health as defined by the EU General Data Protection Regulation (GDPR) or the Turkish Law on the Protection of Personal Data (KVKK), or any similar patient data under applicable local laws.
- User Liability: You agree that Dr.Club is not designed to comply with HIPAA, GDPR health data processing requirements, KVKK health data requirements, or other global health data regulations. If you input patient names, conditions, diagnostic images, or any Personally Identifiable Information (PII) of your patients into our AI prompts or the Service, you do so in direct violation of these Terms. You assume full legal and financial liability for any such breach and agree to fully indemnify and hold harmless DrClub LLC against any resulting claims, fines, or damages.
4. Medical Disclaimer
Dr.Club does not provide medical advice. Any content generated by our AI is for marketing and educational purposes only. You, as the licensed medical professional, retain full responsibility for reviewing, fact-checking, and ensuring the medical accuracy and ethical compliance of all content before publishing it to your social media channels. We assume no liability for the medical accuracy of AI-generated content.
5. Account Registration and Security
To use certain features, you must register for an account. You are responsible for maintaining the confidentiality of your account credentials (including OTP verification codes sent to your email) and for all activities that occur under your account. You agree to notify us immediately at support@drclub.com of any unauthorized use of your account or any other breach of security. In the event of a security incident affecting your account or personal data, we will notify you in accordance with our Privacy Policy, Section 18 (Data Breach Notification).
6. Free Trial and Subscription Tiers
Dr.Club offers both free and paid subscription tiers:
- Free Trial: New users may receive a limited free trial period (30 days) with access to a subset of the Service's features. The free trial is limited to one trial per individual. At the end of the free trial period, your access to trial features will automatically expire unless you upgrade to a paid subscription.
- Paid Tiers (Pro): Certain features of Dr.Club, including expanded AI content generation credits and advanced scheduling capabilities, are subject to billing. All payment processing is securely handled by our third-party processor, Stripe. By subscribing, you authorize Stripe to charge your designated payment method on a recurring basis.
- Cancellation and Refunds: You may cancel your subscription at any time through your account settings. Upon cancellation, you will retain access to paid features through the end of your current billing period. Subscription fees are non-refundable except where required by applicable law.
- Price Changes: We reserve the right to modify our pricing with at least 30 days' prior notice. Continued use of the Service after a price change takes effect constitutes your acceptance of the new pricing.
- Beta Features: From time to time, we may offer access to experimental or beta features. Beta features are provided "AS IS" without any warranties, may contain bugs or errors, and may be discontinued at any time without notice. Your use of beta features is at your sole risk.
7. Third-Party Services and APIs
The Service connects to third-party platforms (Meta/Facebook, Instagram, LinkedIn, X/Twitter, Threads) to analyze trends and publish content. Your use of these connected services is governed by their respective Terms of Service. We are not responsible for the availability, changes in API access, or account suspensions initiated by these third-party platforms.
8. Social Media Publishing, Scheduling, and Data Collection
By connecting your social media accounts to Dr.Club, you:
- Grant Authorization: You explicitly authorize Dr.Club to publish, schedule, and manage content on your connected social media accounts on your behalf, using the OAuth permissions you grant during the account connection process.
- Warrant Authority: You represent and warrant that you have the authority to connect each social media account and grant us the permissions described herein. If you connect an organizational or company page, you represent that you are authorized by the organization to grant us access to manage content on that page.
- Acknowledge Data Collection: You acknowledge and consent to the collection of your public profile data, account identifiers, access tokens, and engagement metrics from each connected platform (Facebook, Instagram, Threads, LinkedIn, and X/Twitter) as described in detail in our Privacy Policy, Section 6. This data is collected solely to provide the Service and is not sold to third parties.
- Content Responsibility: You remain solely responsible for reviewing all content before it is published or scheduled. You must ensure that all posts comply with applicable laws, medical advertising regulations, ethical guidelines, and the terms of the respective social media platforms.
- Revocation of Access: You may disconnect any social media account and revoke access at any time through your Dr.Club account settings. Upon disconnection, any pending scheduled posts for that account will be cancelled and the associated OAuth tokens will be immediately deleted. Content already published to a third-party platform will not be retroactively removed.
- Platform Compliance: Dr.Club is not liable for any violations of third-party platform policies resulting from content you approve for publishing. You acknowledge that social media platforms may independently remove content, restrict accounts, or take other actions in accordance with their own policies.
- Data Shared During Publishing: When content is published through Dr.Club, the post content (text and images) along with any associated account information required by the platform's API will be transmitted to the respective social media platform.
9. Acceptable Use and Anti-Spam Policy
You agree not to use the Service to:
- Send unsolicited commercial messages (spam) in violation of the CAN-SPAM Act, the EU ePrivacy Directive, or any applicable anti-spam legislation.
- Publish content that is defamatory, obscene, harassing, threatening, or that promotes violence, discrimination, or illegal activities.
- Publish misleading health claims, false testimonials, or content that violates medical advertising regulations applicable in your jurisdiction.
- Impersonate another person, entity, or organization, or falsely state or otherwise misrepresent your affiliation with a person or entity.
- Attempt to gain unauthorized access to any portion of the Service, other accounts, systems, or networks connected to the Service.
- Use automated means (other than the Service itself) to access the Service, or use the Service to create competing products or services.
- Circumvent, disable, or interfere with security-related features of the Service.
- Upload, transmit, or distribute any content that infringes upon the intellectual property rights of any third party.
Violation of this Acceptable Use Policy may result in immediate account suspension or termination at our sole discretion.
10. AI-Generated Content Transparency
In accordance with the EU AI Act (Article 50) transparency obligations and U.S. Federal Trade Commission (FTC) guidance, we disclose the following:
- Content generated through the Service is produced by artificial intelligence systems (powered by Google's Gemini models) and is not authored by a human.
- You, as the user, serve as the editorial reviewer. Content undergoes human review before publication when you approve it for publishing. Your approval constitutes human editorial control over the final published content.
- It is your responsibility to clearly disclose the AI-generated nature of content where required by applicable laws or regulations in your jurisdiction, or by the terms of the social media platform to which you publish.
- Dr.Club does not guarantee the factual accuracy, medical correctness, or regulatory compliance of AI-generated content. You must verify all content before publication.
- No Model Training: We do not use your inputs, prompts, or content to train, fine-tune, or improve any AI or machine learning models. We send your data to our AI provider only to generate the content you ask for, or the weekly posts we make for you while automatic weekly posts are on. See our Privacy Policy, Section 15, for how long it is kept.
11. Account Suspension and Termination
We reserve the right to suspend or terminate your account, at our sole discretion, without prior notice, if we reasonably believe that:
- You have violated these Terms, including the Zero-PHI Policy or Acceptable Use Policy.
- Your use of the Service poses a security risk to us or other users.
- Your account has been flagged for fraudulent activity or abuse of the free trial.
- We are required to do so by law, regulation, or a valid legal order.
Upon termination, your right to use the Service will immediately cease. You may request an export of your personal data in a machine-readable format (JSON or CSV) prior to or within 30 days of account termination by contacting privacy@drclub.com. After this period, we will delete your personal data in accordance with our Privacy Policy. Sections of these Terms that by their nature should survive termination shall survive, including but not limited to: Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Indemnification, and Dispute Resolution.
12. Intellectual Property
DrClub LLC retains all rights, title, and interest in the Dr.Club platform, its underlying technology, and its branding. You retain all rights to the raw inputs you provide. Upon generating content through the Service, you are granted a worldwide, non-exclusive license to use, modify, and publish that specific generated content for your professional marketing.
License to Process Your Content: By submitting content, prompts, professional profile data, or other materials ("User Content") to the Service, you grant DrClub LLC a worldwide, non-exclusive, royalty-free, sublicensable license to use, process, transmit, and display your User Content solely for the purpose of providing and improving the Service (including transmitting it to our AI providers for content generation and to social media platforms for publishing). This license terminates when you delete your account or remove the relevant User Content.
Feedback: If you provide feedback, suggestions, ideas, or other communications regarding the Service ("Feedback"), you acknowledge that such Feedback is non-confidential and you grant DrClub LLC an irrevocable, worldwide, royalty-free, fully sublicensable license to use, reproduce, modify, and incorporate such Feedback for any purpose, without obligation or compensation to you.
13. Copyright Infringement and DMCA Policy
We respect the intellectual property rights of others and expect our users to do the same. If you believe that content published through the Service infringes your copyright, you may submit a notice pursuant to the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512, to our designated Copyright Agent:
Copyright Agent:

We will respond to valid DMCA notices in accordance with applicable law, which may include removing or disabling access to the infringing content.
Counter-Notification: If you believe your content was removed due to mistake or misidentification, you may submit a written counter-notification to our Copyright Agent. Upon receipt of a valid counter-notification, we will promptly provide a copy to the original complainant and will restore the removed material within 10 to 14 business days unless the complainant notifies us that they have filed a court action.
Repeat Infringer Policy: We maintain a policy for the termination, in appropriate circumstances, of accounts of users who are determined to be repeat infringers of copyrighted works. If a user receives multiple valid DMCA takedown notices, we may suspend or permanently terminate their account at our discretion.

The arbitration shall take place in the State of Delaware, and the arbitrator's decision shall be final and binding.

You waive any right to participate in a class action lawsuit or class-wide arbitration.
Small Claims Exception: Notwithstanding the above, either party may bring an individual action in small claims court for disputes within the court's jurisdictional limit.
18. Governing Law and Jurisdiction

Any breach of this section shall constitute a material breach of these Terms and grounds for immediate termination.
